1. Acceptance of Terms

By accessing or using Extract by Club Agent ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Extract by Club Agent provides AI-powered transcription and data extraction services that help professionals convert client conversations into completed forms. The Service includes audio transcription, intelligent data extraction, and PDF form filling capabilities.

3. User Accounts

To use the Service, you must:

  • Create an account with accurate information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be at least 18 years old or have parental consent

4. Subscription and Payments

The Service offers free and paid subscription plans. Paid subscriptions are billed monthly through Stripe. You can cancel your subscription at any time, and you will continue to have access until the end of your billing period. Refunds are provided at our discretion.

5. Acceptable Use

You agree not to:

  • Upload content that violates any laws or regulations
  • Upload content you do not have the right to share
  • Attempt to gain unauthorized access to the Service
  • Use the Service to harm, harass, or defraud others
  • Resell or redistribute the Service without permission
  • Use automated systems to access the Service excessively

6. Content and Data

You retain ownership of all content you upload to the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service. You are responsible for ensuring you have the necessary rights and consents to upload and process any recordings or documents.

7. Privacy and Confidentiality

We understand that you may process sensitive client information. We are committed to maintaining the confidentiality of your data as described in our Privacy Policy. However, you are responsible for complying with any applicable privacy laws and obtaining necessary consents from individuals whose information you process through the Service.

8. Accuracy of Results

While we strive for accuracy, the Service uses AI technology that may occasionally produce errors. You are responsible for reviewing and verifying all extracted data before using it. The Service should not be used as the sole source of information for critical decisions.

9. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by Club Agent and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

10. Limitation of Liability

To the maximum extent permitted by law, Club Agent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
